Formalities for selling inherited property in Poland by a foreigner

The transfer of ownership rights after a deceased relative requires the heir to complete a number of formal procedures before Polish administrative authorities. The first step is to obtain a certificate of inheritance (notarial deed of succession) or a court decision confirming the acquisition of the estate. These documents confirm the legal title to the property and make it possible to register ownership in the land and mortgage register.

Proper documentation of property rights facilitates the later sale of inherited real estate in Poland by a foreigner without unnecessary administrative delays. It is also important to report the acquisition of the property to the tax office in order to avoid financial penalties. Timely tax settlement protects the heir’s interests from potential tax audits.

Taxation of the disposal of inherited property

The sale of a property before the expiry of five years from the end of the calendar year in which it was acquired by the deceased gives rise to an obligation to pay income tax. The tax amounts to 19% of the income earned, reduced by documented expenditures incurred on the property.

It is possible to benefit from a housing relief, provided that the funds are allocated to the taxpayer’s own housing purposes within a specified time limit. Foreign residents must also take into account the provisions of double taxation avoidance agreements concluded between the Republic of Poland and their country of residence.
