Disinheritance proceedings are a legal process that allows for the exclusion of an heir from the circle of individuals eligible to inherit under the law or a will, due to exceptional circumstances specified in the Polish Civil Code. Such circumstances include gross neglect of parental duties or severe breaches of duties towards the decedent.
The disinheritance process can be initiated by any heir who believes there is sufficient evidence of such behaviors, as well as by the decedent themselves through a will. This proceeding takes place in court, where the evidence is evaluated, and a decision is made on whether to exclude the individual from the circle of heirs.
