Katarzyna Lewicka-Krzysztowczyk – Lawyer

A member of the L. Zielonka & Partners Tax Firm Limited Partnership team since 2015, Attorney Katarzyna Lewicka-Krzysztowczyk currently serves as a Partner, managing the department for international private law. She specializes particularly in family law and inheritance law procedures, representing foreign clients, mainly in disputes with Polish citizens.

Her scope of activities includes legal representation of foreigners acquiring real estate assets in Poland, as well as advising and representing clients in inheritance proceedings related to the confirmation of inheritance acquisition and division.

Attorney Katarzyna Lewicka-Krzysztowczyk is a member of various international legal organizations, such as the International Society of Family Law, International Academy of Family Law, International Child Abduction Platform, International Mediation Centre MIKK E.V., European Criminal Bar Association, Fair Trials, and the Polish Association of Private International Law. She is also an active member of her local Wrocław Bar Association.

She graduated from the Faculty of Law and Administration at the University of Wrocław and holds a diploma from the Chicago-Kent College of Law. As part of international programs, she participated in scholarships at East Tennessee State University in the United States and the University of Tromsø in Norway.

Attorney Katarzyna Lewicka-Krzysztowczyk is the author of numerous studies and articles on international private law. She regularly participates as a speaker in training sessions and seminars, providing legal services in English.

Leszek Zielonka – Attorney-at-law

Managing Partner at L. Zielonka & Partners Tax Firm Limited Partnership, Leszek Zielonka supervises the international private law department, which focuses on family law and inheritance law.

His supervisory role involves working closely with team members to establish case strategies, providing continuous oversight to ensure proper implementation, and making necessary adjustments to meet the client’s objectives effectively.

The role of the supervising partner is particularly significant in supporting the international private law department’s activities, especially in matters relating to tax law for inheritance cases with cross-border elements.

Leszek Zielonka is a member of several international legal organizations, including the International Society of Family Law, International Academy of Family Law, and International Child Abduction Platform. He is also one of the founders of the Polish Association of Private International Law.

He has completed postgraduate studies in tax law, encompassing elements of foreign law, and provides legal services in English.

Katarzyna Jagiełka – Legal Advisor

Providing legal services for German-speaking clients in the international private law department at L. Zielonka & Partners Law and Tax Firm Limited Partnership.

She is a passionate legal advisor with many years of experience, representing her clients primarily in matters of family and inheritance law, including international court cases, particularly by providing services for German citizens.

The scope of her activities includes legal representation of foreigners acquiring real estate assets in Poland, as well as advising and representing clients in inheritance proceedings related to the confirmation of inheritance acquisition and division.

She is a member of the District Chamber of Legal Advisers. She graduated from the Faculty of Law and Administration at the University of Adam Mickiewicz in Poznań, Poland, and from the Faculty of Law at the European University “VIADRINA” in Frankfurt (Oder), Germany.

Years of experience, continuous training, and teamwork at L. Zielonka & Partners enable her to provide clients with the best legal assistance.

Yes. Foreigners can legally inherit assets in Poland, including real estate, bank accounts, and other property. However, the rules may differ depending on the foreigner’s country of origin — for example, certain restrictions may apply to non-EU citizens, particularly concerning agricultural land. Inheritance is also subject to international private law and bilateral treaties. Professional legal guidance is strongly recommended to ensure a smooth and lawful transfer.

If the deceased was a foreigner or had ties to another country, the applicable law is determined by EU Regulation No. 650/2012 (Brussels IV). This regulation allows a person to choose the law of their nationality in their will. If no choice is made, the law of the country of habitual residence at the time of death applies.

There are two main ways to confirm inheritance:

A court decision (confirmation of inheritance)

A notarial deed of inheritance (faster, if all heirs agree)

Heirs inherit both assets and liabilities. Polish law gives heirs three options:

  • Accept the inheritance in full
  • Accept it with limited liability (beneficium inventarii – up to the estate’s value)
  • Reject the inheritance entirely

This decision must be made within six months of learning about the inheritance.

Yes. Non-EU citizens can inherit real estate and other assets in Poland. However, inheritance of certain types of real estate (especially agricultural land) may require notification to or approval by the Ministry of Internal Affairs. In most urban cases, no special permit is required.
